LearnConnect ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our platform that are reported to our designated Copyright Agent as described below.

1. Reporting Copyright Infringement

If you are a copyright owner, or authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via our Service, please report this by submitting a DMCA takedown notice to our Copyright Agent.

Requirements for DMCA Takedown Notice

To be effective, your DMCA takedown notice must include the following information as required by Title 17, United States Code, Section 512(c)(3):

  • Physical or Electronic Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, a representative list of such works.
  • Identification of Infringing Material: Identification of the material claimed to be infringing or subject of infringing activity, including information reasonably sufficient to permit us to locate the material (such as URL, page title, or specific description of where the material appears on our site).
  • Contact Information: Your contact information including name, address, telephone number, and email address.
  • Good Faith Statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

3. Our Response to DMCA Notices

3.1 Review Process: Upon receiving a valid DMCA takedown notice that complies with all statutory requirements, we will:

  • Promptly review the notice for completeness and validity
  • Remove or disable access to the allegedly infringing material expeditiously
  • Notify the user who posted the material about the takedown and provide them with a copy of the DMCA notice
  • Take reasonable steps to promptly notify the alleged infringer of the removal or disabling of access

3.2 Repeat Infringer Policy: In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

3.3 Timeline: We aim to process valid DMCA notices within 24-48 hours of receipt. However, the actual processing time may vary depending on the complexity of the case and the completeness of the information provided.

4. Counter-Notification Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may file a DMCA counter-notification with our Copyright Agent. To be effective, a counter-notification must include substantially the following information as required by Title 17, United States Code, Section 512(g)(3):

  • Your Signature: Your physical or electronic signature.
  • Identification of Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your Information: Your name, address, and telephone number.
  • Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are located outside India, for any judicial district in which LearnConnect may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Counter-Notification Process: Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA takedown notice. If the original complainant does not file a court action seeking an injunction against the alleged infringement within 10-14 business days, we may restore the removed content at our discretion.

5. Educational Materials and Fair Use

5.1 Educational Purpose: LearnConnect is an educational platform designed to facilitate learning for engineering students. Much of the content shared on our platform, including study materials, notes, and educational resources, may be protected under fair use provisions of copyright law for educational purposes. However, fair use is determined on a case-by-case basis and depends on several factors.

5.2 User Responsibility: Users who upload or share content are responsible for ensuring they have the necessary rights or permissions to share such content, or that their use falls under fair use or other applicable exceptions to copyright law. We encourage users to:

  • Only upload content they own or have permission to share
  • Properly attribute sources when sharing educational materials
  • Understand and respect copyright laws and fair use principles

6. Marketplace Listings and Copyright

6.1 Product Listings: For marketplace listings, copyright claims typically do not apply to the sale of legitimate, legally purchased physical items such as textbooks, electronics, or other goods. However, copyright infringement may occur if:

  • Product descriptions contain copyrighted text copied from other sources without permission
  • Product images are used without authorization from the copyright owner
  • Counterfeit or pirated goods are being offered for sale
  • Digital products being sold violate copyright restrictions

6.2 Seller Obligations: Sellers on our marketplace must ensure that all content in their listings, including text descriptions and images, either belongs to them, is used with permission, or falls under fair use. Selling counterfeit goods or pirated digital content is strictly prohibited.

7. Copyright Infringement in Forums and Discussions

7.1 User-Generated Content: Users participating in our forums, discussions, and community features must respect copyright laws when posting content. This includes:

  • Not posting large portions of copyrighted textbooks or publications
  • Avoiding sharing pirated digital content or links to such content
  • Properly quoting and attributing sources when referencing copyrighted materials
  • Limiting the use of copyrighted materials to what is necessary for discussion and education

7.2 Acceptable Educational Use: Brief quotes, excerpts for the purpose of commentary or discussion, and references to copyrighted works in an educational context may be acceptable under fair use principles, but users should exercise caution and good judgment.

8. Misrepresentations and Penalties

8.1 False Claims: Under the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. We take false copyright claims seriously.

8.2 Consequences: Submitting a fraudulent or bad faith DMCA takedown notice or counter-notification may result in:

  • Legal liability for damages under federal law
  • Permanent ban from LearnConnect platform
  • Reporting to relevant authorities
  • Legal action by affected parties

8.3 Verification: We may take steps to verify the legitimacy of DMCA notices and may reject notices that appear fraudulent or filed in bad faith. Before filing a DMCA notice, please ensure you have a genuine legal claim and are not abusing the DMCA process.

9. Limitations and Disclaimers

9.1 No Active Monitoring: LearnConnect does not actively monitor all user-generated content for copyright infringement. We rely on copyright owners to notify us of any infringements through proper DMCA procedures.

9.2 No Legal Advice: Nothing in this DMCA Policy constitutes legal advice. If you have questions about copyright law, fair use, or whether specific content infringes copyright, please consult with a qualified intellectual property attorney.

9.3 Service Provider Immunity: As a service provider under the DMCA, LearnConnect qualifies for safe harbor protections for user-generated content, provided we comply with DMCA notification and takedown procedures. We are not liable for copyright infringement by our users when we respond appropriately to valid DMCA notices.

9.4 Right to Refuse Service: We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion, with or without receiving a DMCA notice, if we believe copyright infringement is occurring.

10. Changes to This DMCA Policy

We reserve the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting to our website. Material changes will be communicated through appropriate channels. Your continued use of LearnConnect after any changes constitutes acceptance of the updated policy. The "Last Updated" date at the top of this page indicates when this policy was last revised.
